Longmont Man Among Class Action Plaintiffs In Suit Against Edible Marijuana Products Company

COLORADO:  A Longmont man is among the plaintiffs named a class-action lawsuit filed late last month against a Denver edible marijuana products maker on the grounds the company served chocolate bars to people at the Denver County Fair without telling them that the bars contained THC.

The suit, filed Aug. 25 in Denver District Court by Boulder-based lawfirm Frascona, Joiner, Goodman and Greenstein, P.C. alleges that representatives of Beyond Broadway LLC, which has done business as both Full Melt Chocolate and LivWell, handed out the chocolates at the fair’s “Pot Pavilion” on Aug. 1, 2, and 3 this year.

The seven named plaintiffs say they took chocolates from the company’s booth at the fair but “were either not informed that the chocolate contained THC or were expressly told by Broadway representatives that the chocolate contained no THC,” the complaint says.

The suit says after ingesting the chocolates, “the Plaintiffs experienced varying degrees of ill effects including for some, overdose on THC, anxiety, nausea, serious physical illness often requiring treatment and evaluation by a medical provider.”
